Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Dara Finance Inc. ("Dara", "we", "us") governing your use of Dara, including Dara Money, the multi-currency wallet, transfers, family Circles, and card, and Dara Property, the service for buying, financing, and managing US investment property from abroad. By creating an account or using Dara, you agree to these Terms.
Please read these Terms carefully. They include important limitations on our liability, explain the roles of the partners, lenders, and providers involved in delivering the service, and describe how disputes are resolved. If you do not agree, you should not use Dara.
Introduction and acceptance
These Terms, together with the documents they reference, including our Privacy Policy and Cookie Policy, form the agreement between you and Dara. Where a partner institution, partner lender, or provider delivers a specific service, that party's own agreement also applies to that service.
By creating an account, activating a wallet, or otherwise using Dara, you confirm that you have read and accepted these Terms. If you are using Dara on behalf of another person or an entity, you confirm you are authorised to accept these Terms for them.
Definitions
"Account" means your Dara profile and the wallets, balances, and features associated with it. "Circle" means a shared arrangement through which you send money to or share access with family members. "Partner" means a licensed institution that provides banking, card issuance, settlement, or corridor services.
"Balance" means funds recorded to your wallet and held by a Partner. "Partner lender" means a lender that offers financing through Dara Property. "Provider" means an independent third party, such as an appraisal, title, insurance, or entity-formation service, engaged to deliver part of a property transaction. "Entity" means a legal entity, such as an LLC, set up to hold or finance a property.
"Transaction" means any transfer, conversion, payment, or card use you initiate through Dara Money, and any step involved in purchasing, financing, or managing an investment property through Dara Property.
Dara is a platform, not a bank
Dara is a financial technology company. Banking, card, settlement, and property-financing services are provided by licensed partners. Availability and protections vary by product.
Any protection that applies to your funds depends on the relevant partner and jurisdiction, not on Dara. The licensed partner behind each service is identified in your account terms and in-app. Dara is not a law firm, title company, or real-estate broker; regulated steps are performed by appropriately licensed providers.
Eligibility
You must be at least 18 years old and able to form a binding contract under the law that applies to you. You must complete identity verification (KYC) before you can send, receive, or hold funds, or proceed with a property transaction.
We may decline to open an account, or limit the features or steps available to you, where we cannot verify your identity or where doing so is required by law, a partner, a partner lender, or a provider.
Account registration and security
You are responsible for the accuracy of the information you provide and for keeping your credentials secure. You must tell us promptly about any unauthorised use of your account or any suspected security breach.
You are responsible for activity that occurs under your account, and for ensuring that information you provide about an entity is accurate and that you are authorised to act for it. We may require additional verification before allowing certain actions, and you agree to keep your registration details complete and up to date.
Description of the services
Dara Money provides a multi-currency wallet, cross-border transfers, family Circles, and, where offered, a card. Dara Property helps you set up what a US purchase needs, including an LLC, an EIN, and a US bank account, and coordinates appraisal, title, and insurance digitally. Some steps are delivered by third-party service providers.
The specific features available to you depend on your location, your verification status, and the partners that serve your corridor. We may add, change, or withdraw features over time and will aim to give reasonable notice of material changes that affect how you use the service.
Transfers, balances, and Circles
Dara Money lets you hold balances in multiple currencies, send transfers, and share money with family through Circles. Transfers are executed at the rate shown to you in-app at the time you confirm.
Delivery times are estimates and depend on partner rails and destination institutions. Once you confirm a transfer it may not be possible to cancel or reverse it, and Circle arrangements are subject to the roles and limits shown to you when you set them up.
Fees and rates
All applicable fees and the applicable exchange rate are shown in-app before you confirm a transaction. We do not add hidden charges after you confirm. Exchange rates move continuously and are only guaranteed at the moment you confirm a transaction.
Partners, destination institutions, partner lenders, and providers may apply their own charges, which are disclosed by them or surfaced through Dara before you proceed. You are responsible for taxes and government charges that apply to your transactions and to any entity you form.
Card use
Where a Dara card is provided, its use is subject to these Terms and to the card issuer's cardholder agreement, which is presented to you when the card is issued.
You must keep your card and its details secure and report loss, theft, or unauthorised use promptly. Card availability, limits, and supported transactions are set by the issuer and may change.
Financing is for investment property
Any financing offered through Dara Property is for investment (non-owner-occupied) property and is provided through partner lenders. Dara is not the lender unless expressly stated.
Applying does not guarantee approval. Loan terms are set by the lender and disclosed to you before you commit.
Entity, EIN, and US bank setup
Dara Property helps coordinate the setup of a US entity, an EIN, and a US bank account so you can hold and finance investment property. These steps may be delivered with independent formation, banking, and tax-registration providers.
You are responsible for the ongoing obligations of any entity you form, including filings, taxes, and record-keeping, and Dara does not act as your registered agent, accountant, or attorney unless expressly stated.
No guarantee of returns
Property investment carries risk. Dara does not guarantee rental income, occupancy, appreciation, or any investment return.
Any figures, estimates, or calculators are illustrative only and are not a promise of performance.
Third-party services and providers
Dara relies on partner institutions and may link to third-party services. Appraisal, title, insurance, legal formation, and similar services are provided by third parties under their own terms and privacy practices, which you should review.
Where you engage a provider, your relationship for that service is with the provider, and their pricing and terms apply to it. Dara is not responsible for the acts, omissions, content, or availability of independent third parties, though we choose partners with care.
Your obligations
You agree to use Dara only for lawful purposes and in line with these Terms. You must provide accurate information, respond to reasonable requests for verification, and not attempt to interfere with, reverse-engineer, or disrupt the service.
You are responsible for any taxes that apply to your use of Dara. Dara does not provide tax, legal, or investment advice.
Prohibited use, AML and sanctions
You may not use Dara for unlawful activity, fraud, money laundering, terrorist financing, or transactions involving sanctioned persons or jurisdictions. We may block, delay, pause, decline, or reverse transactions and report activity as required by law.
To meet these obligations we, our partners, partner lenders, and providers may request additional information about you, your entity, your source of funds, or a transaction, and may decline or unwind activity that we cannot verify.
Intellectual property
The Dara name, logo, app, website, and content are owned by Dara or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use Dara for its intended purpose.
You may not copy, modify, distribute, or create derivative works from the service except as permitted by these Terms or applicable law.
Disclaimers of warranties
Dara is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or always available, as it depends in part on partners and networks outside our control, and we do not warrant the outcome of any application, appraisal, valuation, or investment.
Limitation of liability
To the extent permitted by law, Dara is not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under the laws of the State of Delaware.
Our aggregate liability arising from your use of Dara is limited to the extent permitted by applicable law.
Indemnification
You agree to indemnify Dara, its partners, its partner lenders, and its providers against reasonable claims, losses, and costs arising from your breach of these Terms, your misuse of Dara, or your violation of law or the rights of others, to the extent permitted by applicable law.
Suspension and termination
We may suspend or close your account where required by law, by a partner, partner lender, or provider, or where we reasonably suspect misuse. Where practical and lawful, we will let you know and explain your options.
You may close your account at any time subject to settlement of pending transactions. Provisions that by their nature should survive termination, including obligations to providers and lenders you have engaged, will continue to apply.
Changes to these Terms
We may update these Terms. We will give notice of material changes; continued use after the effective date means you accept the updated Terms.
If you do not agree to an update, you should stop using Dara and may close your account.
Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, and disputes will be resolved as provided under that law. We encourage you to contact us first so we can try to resolve any concern informally.
