Dara Money: Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Dara Finance Inc. ("Dara", "we", "us") governing your use of Dara Money, the multi-currency wallet, transfers, family Circles, and card. By creating an account or using Dara Money, you agree to these Terms.

Please read these Terms carefully. They include important limitations on our liability and describe how disputes are resolved. If you do not agree, you should not use Dara Money.

Introduction and acceptance

These Terms, together with the documents they reference, including our Privacy Policy, Cookie Policy, Electronic Communications Consent, and Disclosures, form the agreement between you and Dara for Dara Money. Where a partner institution provides a specific service, that partner's own agreement also applies to that service.

By creating an account, activating a wallet, or otherwise using Dara Money, you confirm that you have read and accepted these Terms. If you are using Dara Money on behalf of another person, you confirm you are authorised to accept these Terms for them.

Definitions

"Account" means your Dara Money profile and the wallets, balances, and features associated with it. "Circle" means a shared arrangement through which you send money to or share access with family members. "Partner" means a licensed institution that provides banking, card issuance, settlement, or corridor services.

"Balance" means funds recorded to your wallet and held by a Partner. "Transaction" means any transfer, conversion, payment, or card use you initiate through Dara Money.

Dara is a platform, not a bank

Dara is a cross-border money platform, not a bank. Banking, card issuance, and settlement services are provided by licensed partner institutions. Funds you hold are held by those partners, not by Dara.

Any protection that applies to your funds depends on the relevant partner and jurisdiction, not on Dara. See our Disclosures for the current list of partners and the nature of the services they provide.

Eligibility

You must be at least 18 years old and able to form a binding contract under the law that applies to you. You must complete identity verification (KYC) before you can send, receive, or hold funds.

We may decline to open an account, or limit the features available to you, where we cannot verify your identity or where doing so is required by law or by a partner.

Account registration and security

You are responsible for the accuracy of the information you provide and for keeping your credentials secure. You must tell us promptly about any unauthorised use of your account or any suspected security breach.

You are responsible for activity that occurs under your account. We may require additional verification before allowing certain actions, and you agree to keep your registration details complete and up to date.

Description of the services

Dara Money provides a multi-currency wallet, cross-border transfers, family Circles, and, where offered, a card. The specific features available to you depend on your location, your verification status, and the partners that serve your corridor.

We may add, change, or withdraw features over time. We will aim to give reasonable notice of material changes that affect how you use the service.

Transfers, balances, and Circles

Dara Money lets you hold balances in multiple currencies, send transfers, and share money with family through Circles. Transfers are executed at the rate shown to you in-app at the time you confirm.

Delivery times are estimates and depend on partner rails and destination institutions. Once you confirm a transfer it may not be possible to cancel or reverse it, and Circle arrangements are subject to the roles and limits shown to you when you set them up.

Fees and rates

All applicable fees and the applicable exchange rate are shown in-app before you confirm a transaction. We do not add hidden charges after you confirm.

Exchange rates move continuously and are only guaranteed at the moment you confirm a transaction. Partners or destination institutions may apply their own charges, which we will surface where we can.

Card use

Where a Dara card is provided, its use is subject to these Terms and to the card issuer's cardholder agreement, which is presented to you when the card is issued.

You must keep your card and its details secure and report loss, theft, or unauthorised use promptly. Card availability, limits, and supported transactions are set by the issuer and may change.

Your obligations

You agree to use Dara Money only for lawful purposes and in line with these Terms. You must provide accurate information, respond to reasonable requests for verification, and not attempt to interfere with, reverse-engineer, or disrupt the service.

You are responsible for any taxes that apply to your use of Dara Money. Dara does not provide tax advice.

Prohibited use, AML and sanctions

You may not use Dara Money for unlawful activity, fraud, money laundering, terrorist financing, or transactions involving sanctioned persons or jurisdictions. We may block, delay, or reverse transactions and report activity as required by law.

To meet these obligations we and our partners may request additional information about you or a transaction, and we may decline or unwind activity that we cannot verify.

Intellectual property

The Dara name, logo, app, website, and content are owned by Dara or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use Dara Money for its intended personal purpose.

You may not copy, modify, distribute, or create derivative works from the service except as permitted by these Terms or applicable law.

Third-party services and links

Dara Money relies on partner institutions and may link to third-party services. Those services are governed by their own terms and privacy practices, which you should review.

Dara is not responsible for the acts, omissions, content, or availability of independent third parties, though we choose partners with care.

Disclaimers of warranties

Dara Money is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or always available, as it depends in part on partners and networks outside our control.

Limitation of liability

To the extent permitted by law, Dara is not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under the laws of the State of Delaware.

Our aggregate liability arising from your use of Dara Money is limited to the extent permitted by applicable law.

Indemnification

You agree to indemnify Dara and its partners against reasonable claims, losses, and costs arising from your breach of these Terms, your misuse of Dara Money, or your violation of law or the rights of others, to the extent permitted by applicable law.

Suspension and termination

We may suspend or close your account where required by law, by a partner, or where we reasonably suspect misuse. Where practical and lawful, we will let you know and explain your options.

You may close your account at any time subject to settlement of pending transactions. Provisions that by their nature should survive termination will continue to apply.

Changes to these Terms

We may update these Terms. We will give notice of material changes; continued use after the effective date means you accept the updated Terms.

If you do not agree to an update, you should stop using Dara Money and may close your account.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, and disputes will be resolved as provided under that law. We encourage you to contact us first so we can try to resolve any concern informally.
